End User License Agreement
Effective date: September 18, 2026
This End User License Agreement (the “Agreement”) is between Commercial Dishwasher (“Company,” “we,” “us,” or “our”) and the individual who accesses the Commercial Dishwasher Back Office (the “Application”). By checking the acceptance box on the sign-in screen, or by otherwise using the Application, you agree to this Agreement.
1. Authorized users only
The Application is an internal operations tool. It is not a public product, and restaurant customers and other members of the public may not create accounts or use it.
You may use the Application only if you are an employee, contractor, or other party that Commercial Dishwasher has expressly authorized, and only with an account issued by a Company administrator. There is no public sign-up. If you are not authorized, you must not access the Application and must stop using it immediately.
2. Limited license
Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Application solely to perform your job duties for Commercial Dishwasher. We may change, suspend, or discontinue the Application at any time.
You may not:
- share your sign-in credentials or allow anyone else to use your account;
- access the Application for personal use or on behalf of any third party;
- copy, modify, reverse engineer, or create derivative works of the Application, except as the law allows;
- probe, scan, or test the Application for vulnerabilities, or bypass authentication or role restrictions;
- upload malware or use the Application to send unsolicited communications.
3. Confidential information
The Application contains confidential Company information, including customer accounts, site addresses, contacts, tax identifiers, leases, invoices, visit photos, customer signatures, technician location data, audit records, and billing information. You must treat that information as confidential, use it only for authorized Company work, and not disclose it except as your role and Company policy allow.
4. Ownership
Null Harbor LLC owns the Application source code and related software intellectual property. Commercial Dishwasher has a perpetual license to use the Application and sublicenses access to you under this Agreement. You do not acquire any ownership rights in the software by using it.
Commercial Dishwasher owns the data in the Application — including notes, photos, signatures, invoices, and other records you enter, upload, or generate — and may use that data for its business operations. Null Harbor LLC does not own that data.
5. Integrations
The Application may connect to third-party services that administrators configure, including Intuit QuickBooks Online, email delivery, file storage, and mapping. Your use of those connections is limited to the access your role is given. We are not responsible for third-party services we do not control.
6. No warranty
The Application is provided “as is” and “as available” for internal business use. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Application will be uninterrupted, error-free, or free of harmful components.
7. Limitation of liability
To the fullest extent permitted by law, Commercial Dishwasher and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising from your use of the Application. Our total liability for any claim relating to the Application will not exceed one hundred dollars (US $100).
8. Suspension and termination
We may deactivate your account or end this license at any time, with or without notice, including when your employment or other authorization ends. When access ends, you must stop using the Application and return or destroy any Company information in your possession, except as the law or Company policy requires you to keep it.
Provisions that by their nature should survive — including confidentiality, ownership, disclaimer, and limitation of liability — remain in effect after this Agreement ends.
9. Changes
We may update this Agreement from time to time. The effective date at the top of this page is the current version. Continued use of the Application after a change, including accepting the updated terms on the sign-in screen, means you accept the revised Agreement.
10. Governing law
This Agreement is governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any dispute arising from this Agreement or the Application will be resolved in the state or federal courts located in Clark County, Washington, and you consent to that venue.
